Alternate Methods & Modifications
Section 104.11 of the California Building Code allows the building official to approve modifications and/or alternate materials, alternate design, and methods of construction.
The building official may grant modifications when there are practical difficulties in carrying out the provisions of the code. There must be a special individual reason that makes the strict letter of the code impractical. The modification must be in conformance with the intent and purpose of the code. It may not lessen any fire protection requirement or degree of structural integrity.
The building official may approve alternate methods and materials. The applicant must demonstrate that the proposed alternate is at least the equivalent of the code requirement for suitability, strength, effectiveness, fire resistance, durability, safety, and sanitation. Evidence or proof to substantiate claims may be required.
Discussion
The Town will not process requests for alternates where equivalency is not demonstrated. Financial hardship is not an adequate reason to violate the building code. The code is a minimum standard.
Procedure
Send a letter to Chief Building Official, Mike Ross requesting such. Include the job address, permit number, and a letter with specific documentation and information that demonstrates that the proposal is equivalent to or exceeds the code requirement.
