Claim for Damages
All claims of personal injury or property damage against the Town of Truckee must be filed via a claim form. Claimants must complete the Town of Truckee claim form, located on our Claims Processing webpage, and submit the completed form with all required attachments. Filing online provides for the quickest processing time, but the Town can also accept in person, by email at claims@townoftruckee.gov, or via mail at Town of Truckee, Risk Management Division, 10183 Truckee Airport Road, Truckee, CA 96161.
In most cases you are required to take certain steps before filing a lawsuit against a government entity. The Government Claims Act (Government Code sections 810-996.6) outlines what you must do before bringing action in a court of law.
The claims procedure is complex. You have a right to seek advice and guidance from an attorney of your choosing. No employee of the Town of Truckee can provide legal guidance to a member of the public.
Things You Should Know
Right-of-Ways for Town Snow Storage
The public right-of-way is used by the Town for storage of snow plowed from the streets. It is not available for snow storage for individuals. The right-of-way varies in each subdivision. An average right-of-way is 60 feet (approximately 30 feet on either side of the center of the roadway). Tahoe Donner has a 60-feet right-of-way with an additional 20 feet on each side for snow storage, except for Northwoods Boulevard which has an 80 feet right-of-way with an additional 20 feet for snow storage. A good indicator is telephone poles, which are usually located within the street right-of-way, about 3 feet from the edge of the private property line.
Mailboxes
Any mailbox installed within the Town right-of-way is placed there at the owner's risk. Therefore, owners are encouraged to install mailboxes at the maximum usable distance from the edge of the roadway. Posts should be checked for deterioration to reduce the possibility of breakage due to the weight of plowed snow.
Roadside Parking Ban
Per Town Code Section 10.17.030, from November 1 to April 30, it is illegal to park vehicles in the Town right-of-way. This code is strictly enforced by law enforcement, and you may be cited and/or towed. Please note that the right-of-way extends beyond the edge of the road pavement (see Right-of-Ways above) inward beyond the snow poles.
